Annual Leave Entitlement: Labour Law Article 53

In Turkey, the right to paid annual leave is guaranteed by Article 53 of Labour Law No. 4857. Employees who have worked at a workplace for at least one year earn annual paid leave that varies in length based on their seniority. The employer is obliged to pay for the leave.

At workplaces with more than 50 employees, workers aged 50 and over must be granted at least 20 working days of leave.

Key Rules

  • Annual leave entitlement is transferable but cannot be sold for cash while the employment contract is still active.
  • When the employment contract ends, unused leave is paid out as wages.
  • Leave may be split by the employer into at most three portions; at least 10 working days must be taken consecutively.
  • The employee is not required to formally request annual leave; the employer has an obligation to ensure it is taken on time.
