How Are Annual Leave Days Set Under Turkey's Labor Law?
Under Article 53 of Labor Law No. 4857, paid annual leave is tied directly to an employee's tenure at the workplace. Annual leave is a constitutional right to rest. It cannot be waived even with the employee's consent and cannot be cashed out while employment continues.
1 to 5 Years of Tenure (14 Days)
An employee who completes a full year at the workplace, including the probation period, is entitled to a minimum of 14 paid leave days per year. This rate applies every year until the end of the fifth year.
More Than 5 and Less Than 15 Years (20 Days)
For employees who complete five full years at the same workplace, the entitlement expands. From the sixth year through the fifteenth, the minimum paid annual leave is 20 days per year.
15 or More Years of Tenure (26 Days)
Long-tenured employees who complete 15 full years with the same employer must legally receive at least 26 paid annual leave days every year.
Special Age-Based Exceptions for Annual Leave
The Labor Law also includes special leave rules that protect specific age groups regardless of tenure. These positive-protection rules are designed to safeguard the physical and mental wellbeing of very young and older workers.
Minimum Leave for Workers Under 18 and Over 50
If the worker is 18 or younger, or 50 or older, the annual paid leave cannot be less than 20 days, even when tenure is just one year.
